Terms and Conditions of Sale

Article 1, Purpose

These General Terms and Conditions of Sale (hereinafter "GTC") govern sales concluded on the MAZALET website between MAZALET, operated by Clément DEVILLIERS, an individual entrepreneur, and any individual or legal entity making a purchase on the website.

Article 2, Acceptance of GTC

Any order placed on the website implies the customer's full and complete acceptance of these GTC. The customer acknowledges having read them before validating their order.

Article 3, Products

MAZALET offers clothing, accessories, textile creations, and, where applicable, customized or made-to-order pieces for sale. Products are described with the utmost care. Photographs, visuals, and descriptions aim to present the products faithfully, without being able to guarantee perfect similarity, particularly due to screen settings, shooting lighting, or artisanal manufacturing specificities.

Article 4, Manufacturing and Positioning

MAZALET pieces are designed with a high-end approach, with particular attention paid to materials, cut, finishes, and manufacturing. The brand prioritizes French manufacturing, mainly in Paris, as well as the use of natural materials selected from French and European suppliers.

Article 5, Prices

Prices are indicated in euros. The applicable prices are those displayed on the website at the time of order validation. MAZALET reserves the right to modify its prices at any time, without affecting already validated orders.

Article 6, Launch Offer and Pre-orders

Upon the website's launch, MAZALET may offer a launch offer in the form of pre-orders. For a period of three weeks from the official opening of the website, certain products may benefit from an exceptional discount, including 20% off most of the collection, unless otherwise specified for certain pieces benefiting from a specific discount, for example 10%.

A pre-order means that the customer orders and pays for their product during the launch offer period, accepting a longer manufacturing and delivery time than the usual delay. Production of pre-ordered pieces begins at the end of the pre-order period. Orders are processed in order of arrival, subject to production constraints and material availability.

The specific conditions of the pre-order, including applicable discount, estimated lead time, and manufacturing terms, are indicated on the website and in the article dedicated to how pre-orders work.

Article 7, Order

The customer selects the products of their choice, adds them to the cart, checks the details of their order, enters the necessary delivery and payment information, and then validates their order. Validation of the order constitutes a firm commitment by the customer, subject to applicable withdrawal rights.

Article 8, Order Confirmation

After payment validation, a confirmation email is sent to the customer at the address provided during the order. The customer is invited to check the accuracy of their information and to contact MAZALET promptly in case of error.

Article 9, Payment

Payments are secure and can be made by credit card (Visa, Mastercard, American Express, and other compatible cards), Apple Pay, Google Pay, Shop Pay, PayPal, as well as any other payment method offered during order validation. Available payment methods may evolve at any time depending on the solutions activated on the Shopify store.

Article 10, Payment Default

MAZALET reserves the right to suspend or cancel any order in case of payment authorization refusal, incomplete payment, suspicion of fraud, or payment incident.

Article 11, Availability

Products are offered within the limits of available stock or according to pre-order conditions. In case of unavailability after order validation, MAZALET will inform the customer as soon as possible and will offer, depending on the case, a refund, an exchange, a credit note, or an additional manufacturing delay.

Article 12, Delivery

MAZALET delivers in France and internationally. Carriers are selected according to the country of destination, package type, weight, volume, product value, and available services. Carriers may include DHL, Chronopost, Colissimo, Mondial Relay, or any other suitable carrier.

Delivery costs are calculated automatically during the order, based on the destination, carrier, weight, volume, selected delivery method, and, where applicable, duties, taxes, or fees applicable outside France.

Article 13, International Deliveries and Customs Fees

For deliveries outside France or the European Union, taxes, customs duties, import fees, or administrative fees may be applied by the authorities of the destination country or by the carrier. These costs are borne by the customer, unless otherwise indicated during the order. The customer is invited to inquire with the competent authorities of their country before ordering.

Article 14, Delivery Times

The times indicated on the website are estimated times. During the pre-order period, lead times are longer and depend on the indicated manufacturing schedule. Outside the pre-order period, the estimated average lead time is approximately fifteen days, subject to product availability, destination, and carrier.

Article 15, Package Receipt

The customer must check the condition of the package upon receipt. In case of a damaged, opened, incomplete, or visibly deteriorated package, the customer must make reservations with the carrier and inform MAZALET as soon as possible, with photographs if possible.

Article 16, Right of Withdrawal

In accordance with consumer law applicable to distance selling, the consumer has, with legal exceptions, a period of fourteen days from receipt of the product to exercise their right of withdrawal, without having to justify their decision.

To exercise this right, the customer must contact MAZALET at contact@mazalet.com, indicating their order number, the product(s) concerned, and their wish to withdraw. MAZALET will then communicate the return procedure.

Article 17, Exceptions to the Right of Withdrawal

The right of withdrawal does not apply, in accordance with the exceptions provided for by the Consumer Code, to products made to customer specifications, clearly personalized, custom-made, modified at the customer's request, or specially adapted to their measurements, choices, or particular instructions.

Article 18, Return Conditions

Returned products must be in their original condition, unworn, unwashed, unstained, undamaged, unscented, with their original tags, any accessories, and their original packaging. MAZALET reserves the right to refuse a return or to apply a discount if the returned product does not meet these conditions or shows signs of use beyond simple product verification.

Article 19, Return Costs

Unless the error is attributable to MAZALET or otherwise indicated, return costs are the responsibility of the customer. For international returns, costs, taxes, and any duties related to the return remain the responsibility of the customer.

Article 20, Refund

In case of a valid withdrawal and conforming return, the refund will be made using the original payment method or any other method agreed upon with the customer, within the deadlines provided by applicable regulations, after receipt and inspection of the returned product. Initial delivery costs may be refunded according to applicable legal conditions, excluding additional costs related to choosing a more expensive delivery method than the standard method offered.

Article 21, Exchanges

Exchange requests can be sent to MAZALET within fifteen days of receiving the order. Exchange is subject to the condition of the returned product and the availability of the new size, color, or piece requested. Personalized or custom-made products cannot be exchanged, except in case of defect or error attributable to MAZALET.

Article 22, Personalized, Custom-Made Products and Exceptional Creations

MAZALET can offer, upon request, custom-made pieces, adaptations, specific alterations, or exceptional creations intended for particular events. These requests will be subject to prior discussion, and possibly a quote or specific validation. Personalized products, made on request, or adapted to customer specifications do not benefit from the right of withdrawal, except in case of non-conformity or hidden defect.

Article 23, Legal Guarantees

The customer benefits from legal guarantees of conformity and guarantees relating to hidden defects under the conditions provided by law. These guarantees apply independently of any commercial guarantee that may be offered.

Article 24, Size Advice and Support

MAZALET provides size guides and can assist the customer in choosing their size, particularly for unisex collections. The advice given is based on information provided by the customer, including measurements, wearing preferences, and desired style. The customer remains responsible for the final choice of the ordered size.

Article 25, MAZALET Club

The MAZALET Club allows members to benefit, according to the current conditions, from personalized support, previews, invitations to certain events, private sales, exclusive content, or special attentions. Club registration may require creating a customer account and agreeing to receive certain communications, in compliance with GDPR.

Article 26, Liability

MAZALET cannot be held responsible for indirect damages, loss of opportunity, loss of data, service interruptions, or technical difficulties beyond its control. MAZALET's liability cannot be engaged in case of improper use of the product, non-compliance with care instructions, or normal wear and tear.

Article 27, Force Majeure

MAZALET cannot be held responsible in case of non-performance or delay due to an event of force majeure, including natural disaster, strike, epidemic, fire, transport blockage, exceptional supply shortage, administrative decision, or unforeseeable and irresistible external event.

Article 28, Personal Data

Personal data collected in the context of orders is processed in accordance with the website's Privacy Policy.

Article 29, Mediation and Disputes

In case of dispute, the customer is invited to contact MAZALET first to seek an amicable solution. Failing resolution, the consumer customer may resort to a consumer mediator. Consumer mediator: FEVAD Consumer Mediator, subject to MAZALET's effective membership in the scheme.

Article 30, Applicable Law

These GTC are subject to French law. In case of dispute, the competent courts will be determined in accordance with applicable legal rules.
